1. Acceptance of Terms
Welcome to Voluta. By accessing or using our website, mobile application, progressive web app, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Voluta (“we,” “us,” or “our”).
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the effective date above. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
2. Account Registration and Eligibility
To use certain features of the Service, you must create an account. You may register using your email address and password, or through a supported third-party authentication provider such as Google OAuth. You must be at least 13 years of age to create an account or use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized access to or use of your account.
We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violations of these Terms.
3. Description of Service
Voluta is a book tracking and social reading platform that allows users to:
- Track books they have read, are reading, or want to read
- Log reading progress, set goals, and view reading analytics
- Create and manage custom book lists
- Rate and review books
- Participate in book discussions, book clubs, and buddy reads
- Follow other readers and share reading activity
- Import library data from other reading platforms
- Access book metadata from third-party sources including Open Library and Google Books
4. User-Generated Content
The Service allows you to create, submit, post, and share content including but not limited to book reviews, ratings, reading notes, forum posts, discussion comments, book lists, club feed posts, buddy read discussions, and feature requests (“User Content”).
Ownership: You retain all ownership rights to your User Content. By submitting User Content to the Service, you grant Voluta a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content solely in connection with operating and providing the Service.
Responsibility: You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to grant the licenses described herein and that your User Content does not infringe or violate any third-party rights.
Removal: We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, offensive, or harmful, at our sole discretion and without prior notice.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Post or transmit content that is defamatory, obscene, harassing, threatening, or hateful
- Impersonate any person or entity or misrepresent your affiliation
- Upload or distribute malware, viruses, or other harmful code
- Attempt to gain unauthorized access to any part of the Service or its systems
- Scrape, crawl, or use automated means to access the Service without permission
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for spam, unsolicited advertising, or commercial solicitation
- Create multiple accounts to circumvent restrictions or bans
- Manipulate voting, reviews, or other community features through fraudulent means
6. Subscriptions and Billing
Voluta offers both free and premium subscription plans. The free plan provides core functionality including book tracking, library management, and basic community features, and may include advertisements. Premium plans provide additional features such as advanced analytics, an ad-free experience, and other premium perks.
Payment Processing: All payments are processed securely through Stripe, our third-party payment processor. We do not store or have access to your full payment card information. By subscribing to a paid plan, you agree to Stripe's terms of service and privacy policy.
Billing Cycles: Subscriptions are billed in advance on a recurring basis (monthly, semi-annually, or annually, depending on the plan you select). Each billing cycle begins on the date you first subscribe.
Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. No refunds will be issued for partial billing periods.
Price Changes: We reserve the right to change subscription prices at any time. If we change pricing, we will provide notice at least 30 days before the change takes effect. Your continued subscription after a price change constitutes acceptance of the new price.
7. Intellectual Property
The Service, including its design, features, content, software, and branding (excluding User Content and third-party content), is owned by Voluta and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without prior written consent.
Book metadata, cover images, and related bibliographic data displayed on the Service may be sourced from third-party providers including Open Library and Google Books, and remain the property of their respective owners or licensors. Amazon product links and associated data are provided through the Amazon Associates Program.
8. Third-Party Services
The Service integrates with and relies upon third-party services, including but not limited to:
- Supabase — Authentication, database hosting, and backend infrastructure
- Google — OAuth authentication (Sign in with Google)
- Stripe — Payment processing for subscriptions
- Open Library / Google Books — Book metadata and cover images
- Amazon Associates — Affiliate product links
- Upstash — Rate limiting and caching infrastructure
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
9. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in our Privacy Policy.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOLUTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
Book metadata, ratings, and other bibliographic information provided through the Service is sourced from third-party databases and may not always be accurate or complete. We make no representations or warranties regarding the accuracy of such data.
11. Indemnification
You agree to indemnify, defend, and hold harmless Voluta, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
12. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease.
Upon account deletion, we will delete your personal data in accordance with our Privacy Policy, except where retention is required by law or for legitimate business purposes. Anonymized or aggregated data that cannot be used to identify you may be retained.
13. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voluta regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
